If your Call-Out notice arrives at a difficult time for you or your employer, you both have the right to have it postponed or cancelled by making an application for exemption, deferral or revocation to an Adjudication Officer.

The Adjudication Officer will review the facts of the case and make a ruling. If he rules in your favour, the result is normally:

  • Exemption: You’ll be exempt from Call-Out both now and in the future.
  • Deferral: Your reporting date for Call-Out will be formally changed to a later one.
  • Revocation: Your Call-Out notice will be repealed for a specified period of time.

What grounds could you have for exemption, deferral or revocation?

This would vary from case to case, but, as an example, sufficient grounds could include:

  • you have primary parental or care responsibilities
  • you are engaged in full-time education or training
  • you are self-employed or work in a family-run business which would be seriously harmed by your absence
  • you have entered into a contract of employment but have not yet started work and your employer won’t agree to postpone your start date
  • other compassionate reasons

How to apply for exemption, deferral or revocation of mobilisation

If you want to apply for exemption, deferral or revocation of mobilisation, you should do this within seven days of your call-out papers being served. If you don’t, you’ll have to get permission to make a late application from the Adjudication Officer (see addresses below).This is usually a serving officer or an official appointed by the Ministry of Defence. Your employer also has the right to apply for exemption or deferral if your mobilisation occurs at a difficult time for them.

How your application will be decided

A Service Adjudication Officer will decide whether an application for exemption, deferral or revocation will be accepted. Every effort will be made to do this quickly and with a thorough understanding of the implications for you, your family or your employer. This is done by balancing your needs, or your employer's, against the needs of the operation and the specific duties for which you have been called out.

What options are available if an application is unsuccessful?

If you are dissatisfied with an Adjudication Officer's decision you can apply to a Reserve Forces Appeals Tribunal (RFAT).
